is in my opinion limited. He cannot exercise that power

to nullify the express objects of the Ordinance. He must

exercise it for a purpose consistent with the purpose

for which the Ordinance was passed, the construction and

maintenance of the proposed Tramways; this exercise of

it must be reasonable. The only reasonable object for

which such a power could or ought to be excercised is for

the purpose of securing that the proposed grantee is a

fit and proper person to have such a grant, one who bonâ

fide intends to use the powers so granted for the purpose:

for which they were given and who has the ability and

the means to carry out the scheme.

6. The grounds on which the Government

have refused to sanction the transfer are in my opinion

wholly unjustifiable.
